Watergeeks provides the Watergeeks Platform subject to your compliance with, as applicable, this Policy and the terms and conditions which can be found at https://staging7.watergeeks.io/terms-of-use/. By accessing and using the Watergeeks Platform, you agree to be bound by the terms and conditions contained in these documents. If you do not agree to be bound by these terms and conditions, please do not access or use the features of the Watergeeks Platform.
2. Modifications to the Policy
We reserve the right to change this Policy at any time. We will do so by posting a revised Policy on the Watergeeks Platform. If any such revision results in a material change to this Policy, as determined by Watergeeks in its sole discretion, we will notify you by posting a notice on the Watergeeks Platform or by sending you an email at the address you have registered with us. The date of the version of this Policy is stated at the end of this policy. Please review this Policy periodically. Your continued use of the Watergeeks Platform following the posting of changes to this Policy, whether you have been directly notified or not, constitute acceptance of those changes. We recommend that you print a copy of this Policy for your records.
3. Cookies and tracking information
Your use of the Watergeeks Platform allows Watergeeks to automatically compile tracking information that may include the Internet Protocol (IP) address of your computer, the operating system you are using, the identity of your Internet service provider, the date and time you accessed the Watergeeks Platform, the previous website which allowed you to link with the Watergeeks Platform, and the content viewed and downloaded from our website.
With most Internet browsers, you can erase cookies from your computer’s hard drive, block the creation of cookies or receive a warning before a cookie is stored, although doing so may affect your use of the Watergeeks Platform and your ability to access certain features of the Watergeeks Platform.

Depending on the nature and sensitivity of your personal information, your consent can be express and positive (express and positive consent may be oral, in writing or electronic) or implied (such as providing information voluntarily). Your consent can be withdrawn at any time, subject to legal and contractual restrictions and a reasonable notice. Please note that if you choose to withdraw your consent, Watergeeks may not be able to provide you with certain products or services.

Watergeeks only collects personal information about you that is necessary for the purposes of establishing, managing and maintaining our relationship with you. For example, and without limitation, personal information may be collected when you open an account, post a bid or offer in connection with Item, buy or bid on Item, subscribe to receive our newsletter, submit information, documents, questions, comments or suggestions, and participate in other online interactive activities, and may include, but is not restricted to, identification information such as your first and last name, the name of your company, your business address, your telephone number, and your email address.
Generally, we will obtain your personal information directly from you. However, we may also collect personal information about you from outside sources with your consent, without your consent if the law so authorizes.
6. General use of your personal information
Without limitation, Watergeeks may use your personal information for the following purposes:
- to identify you as a user of our website;
- to give you access to the website located at www.watergeeks.io and related softwares and services;
- to invoice you for your use of our softwares and services;
- to establish and maintain our business relationship with you;
- to provide you with ongoing service;
- to improve our products and service offerings, including the use of the Watergeeks Platform;
- to communicate with you when you submit information, documents, questions, comments or suggestions;
- to provide you with information about our business, products and services that may be of interest to you;
- to prevent errors and fraud;
- to comply with our legal obligations;
- to enforce our Terms of Service, and;
- as otherwise set forth in this Policy.
Watergeeks may also use any information you provided via our services to compile statistics. However, these statistics will not allow you to be identified. In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our website’s functionality and user-friendliness, to better tailor it to our visitors’ needs, and to detect suspicious activity. These third party service providers, such as our payment processors, have their own privacy policies addressing how they use such information.
Your personal information shall not be used for purposes other than those described above except with your consent or as required or authorized by law.
If you choose to create an account on the Watergeeks Platform, you will be able to create a profile associated to your account, which will be publicly viewable via the Watergeeks Platform. Such profile information may include, but is not limited to, profile picture, name, location, information on your organization, industry and sales and purchases conducted via the Watergeeks Platforms and outside the Watergeeks Platforms and feedback/rating information. You may edit your profile via your account.
8. Item offers and item bids
If you choose to post either an Item Offer or an Item Bid via the Watergeeks Platform, the contents of such posting will be viewable via the Watergeeks services. Postings may include information directly connected to such Item Offer or Item Bid but may also include or provide access to information available on your profile, including feedback and rating information and timing of job performance. If you choose to submit an Item Offer or an Item Bid in response to a posting via the Watergeeks Platform, we may share with the Other User the information related to your submission, including, but not limited to any of the information contained in your profile.
9. Client-Contractor Communication and Work Product
As part of the Watergeeks Platform and the services provided therewith, we may collect information and communication exchanged between Users. Such data may include information input, sent or delivered by Users such as a memo, Item details and delivery timeline and responses to queries.
10. Communication of your personal information
Watergeeks recognizes that, except in the cases and under the conditions described hereinafter, the communication of your personal information to a third person requires your consent.
Access within Watergeeks does not require your consent, but is strictly limited to the persons for whom such information is necessary for the performance of their functions and duties.
Watergeeks may also share your personal information, without your consent, with agents, mandataries, consultants, data processors, service providers and other parties who require such information in connection with Watergeeks’s activities or to assist Watergeeks with administering our business relationship (e.g., assisting with promotions, providing technical assistance for the website, etc.). Such agents, mandataries, consultants, data processors, service providers and other parties will contractually guarantee to Watergeeks that they will use your personal information exclusively to provide specific services and that they will keep it confidential in accordance with this Policy and return it to Watergeeks once the service has been provided, without keeping any copy.
Watergeeks may also, without your consent, communicate your personal information contained in a file it holds on you as authorized or required by law.
In each situation where Watergeeks discloses your personal information, it will endeavour to not disclose more personal information than is required under the circumstances.
Please note that in the event that the third party to whom Watergeeks discloses personal information about you is located in a foreign jurisdiction, local laws may otherwise allow your personal information to be accessed by third parties without your consent.
11. Accuracy and safeguards
Watergeeks has put in place a series of security safeguards to protect your personal information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification, regardless of the format in which the information is held.
These security safeguards include physical measures, organizational measures and technological measures that are reasonable given the sensitivity of the information, the purposes for which it is to be used, the quantity and distribution of the information and the medium on which it is stored.
Watergeeks also takes the necessary measures to ensure that all its managers and employees are trained on the contents of this Policy and understand that they are required to conform to it at all times.
Watergeeks further recognizes that it is important to keep personal information accurate, complete and up-to-date, and takes reasonable steps to ensure the accuracy and completeness of the personal information it uses or discloses. However, you are responsible to inform Watergeeks of any significant changes in your personal information which may occur during the course of our business relationship.
Watergeeks will destroy, erase or make anonymous your personal information that is no longer required to fulfill the identified purposes, legitimate business purposes or legislative requirements.
Identity theft and the practice currently known as “phishing” are of great concern to Watergeeks. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your account ID, login password, or personal identification numbers in a non-secure or unsolicited e-mail or telephone communication. We suggest you not to respond to and to promptly report any email or telephone communication purporting to be from Watergeeks in which such information is collected.
13. Complaint procedure and access and rectification requests
All questions or concerns regarding this Policy or about the collection, use and disclosure of your personal information, including requests for access or rectification, should be made in writing to info@Watergeeks.io.
You have the right to consult and obtain a copy of your personal information which is contained in a file held by Watergeeks. You can also request that information which is inaccurate, incomplete or equivocal be rectified, and that information not justified for the purpose of the file be deleted.
Watergeeks will respond to every request for access and rectification within 30 days of receiving the written request. In the event that Watergeeks cannot provide access to or rectify your personal information, it will inform you of the reasons why and will provide you with any recourse available.
14. International Transfer
Your information may be transferred outside of the jurisdiction in which you reside and may be stored or otherwise maintained on information systems and devices located in jurisdictions where the privacy laws differ from and in some cases may not be as protective as those in your jurisdiction. If you are located outside Canada and choose to provide information to us, Watergeeks transfers personal information to Canada and processes it there. Your consent to this Policy followed by your submission of such information represents your agreement to that transfer and your acknowledgement and acceptance of the fact that the treatment of such information will governed by the laws of the province of Québec and federal laws applicable therein.
